新楊思中央公園國際方案征集資格預(yù)審公告
上海國際招標(biāo)有限公司受上海迎博房地產(chǎn)開發(fā)有限公司（“征集人”）的委托，作為征集代理，就新楊思中央公園組織開展國際方案征集活動(dòng)，歡迎有興趣參與應(yīng)征的申請人參加本次征集活動(dòng)。本次征集將通過公開資格預(yù)審的方式從所有申請人中擇優(yōu)選取3名應(yīng)征人參加征集。
Entrusted by Shanghai Yingbo Real Estate Development Co.,Ltd.(“Sponsor”)as the Solicitation Agency,Shanghai International Tendering Co.,Ltd.(“SITC”)is organizing the International Scheme Solicitation for New Yangsi Central Park(“Project”).SITC welcomes all Applicants who are interested in this Project to participate.Through open prequalification,3 applicants(“Shortlisted Applicants”)will be selected to enter the following Solicitation Stage.
《上海市浦東新區(qū)國土空間總體規(guī)劃（2017-2035）》指出，浦東新區(qū)將圍繞“一主、一新、一軸、三廊”的總體空間結(jié)構(gòu)進(jìn)行發(fā)展布局。結(jié)合目前城市空間發(fā)展趨勢，浦東新區(qū)沿中環(huán)尋求發(fā)展區(qū)域承接相關(guān)功能有著重要意義。新楊思作為“金色中環(huán)發(fā)展帶”的重要潛力地區(qū)，同時(shí)又是浦東新區(qū)總規(guī)規(guī)劃地區(qū)中心，在十四五期間將形成新的區(qū)域發(fā)展亮點(diǎn)。
The Overall Plan for Land and Space of Pudong New Area in Shanghai(2017-2035)points out that Pudong New Area will develop and layout around the overall spatial structure of"one main,one new,one axis,and three corridors".Considering the current trend of urban spatial development,it is of great significance for Pudong New Area to seek development areas along the Central Ring Road to undertake related functions New Yangsi,as an important potential area of the"Golden Middle Ring Development Belt"and also the center of the Pudong New Area's overall planning,forms new regional development highlight during the 14th Five Year Plan period.
為響應(yīng)新區(qū)推進(jìn)“金色中環(huán)”高質(zhì)量建設(shè)發(fā)展的目標(biāo)，進(jìn)一步優(yōu)化片區(qū)控規(guī)、深化定位研究，提升新楊思區(qū)域整體環(huán)境，保障后續(xù)開發(fā)建設(shè)的順利推進(jìn)，浦發(fā)集團(tuán)秉持規(guī)劃先行、配套先行的工作思路，在總體規(guī)劃及定位策劃的基礎(chǔ)上，先行啟動(dòng)新楊思核心區(qū)范圍內(nèi)道路、學(xué)校、公園綠地等配套設(shè)施的建設(shè)。以“創(chuàng)意、融合、綠色為核心的靈感之城”為定位愿景，啟動(dòng)新楊思中央公園景觀概念方案征集，倡導(dǎo)綠色可持續(xù)的新都市生活，推行ESG韌性城市發(fā)展理念，誠邀國際具有卓越水平和豐富經(jīng)驗(yàn)的設(shè)計(jì)單位參與，運(yùn)用前瞻性設(shè)計(jì)指導(dǎo)新楊思地塊的后續(xù)發(fā)展。
In response to the goal of promoting high-quality construction and development of the"Golden Middle Ring"in Pudong New Area,further optimizing the regulatory plan of the area,deepening positioning research,improving the overall environment of New Yangsi,and ensuring the smooth progress of subsequent development and construction,Shanghai Pudong Development Group adheres to the philosophy of planning and supporting facilities go first.The construction of supporting infrastructure such as roads,schools,parks,and green spaces within the core area will be first launched on the basis of the overall planning and positioning.With the positioning vision of"inspiration city with creativity,integration,and green as the core",advocating for green and sustainable new urban life,and promoting the ESG resilient urban development concept,we are now launching the solicitation for New Yangsi Central Park conceptual schemes.We sincerely invite design units with excellent level and rich experience worldwide to participate,and use advanced design to guide the subsequent development of New Yangsi plots.
本項(xiàng)目征集范圍主要包括：對本項(xiàng)目研究范圍內(nèi)景觀空間提出整體打造策略；對中央公園地塊提出整體概念方案；以及對核心區(qū)道路景觀系統(tǒng)提出設(shè)計(jì)策略及概念方案。
The scope of this project mainly includes two parts:proposing an overall landscape design plan for each green space plot within the research scope;And propose landscape construction strategies and conceptual design plans for the green space of the central park plot in the core area.
S1：新楊思地區(qū)景觀設(shè)計(jì)研究范圍（其中綠地面積約24.42萬平方米），研究內(nèi)容包括景觀空間整體策略及概念意向。
The landscape design and research area(green space area about 244,200 square meters),research content includes overall strategy and concept intention of the landscape space.
S2：核心區(qū)中央公園（綠地面積約4.45萬平方米），完成景觀概念設(shè)計(jì)方案。
The central park in the core area(green space area about 44,500 square meters),design content includes landscape conceptual design scheme.
S3：核心區(qū)范圍道路景觀系統(tǒng)提出總體策略，選取典型道路完成景觀概念設(shè)計(jì)方案，并形成指導(dǎo)后續(xù)深化設(shè)計(jì)的設(shè)計(jì)導(dǎo)則。
Road landscape system in the core area,design content includes overall strategy,landscape conceptual design scheme of the typical road and design guidelines for guiding subsequent deepening design.

3.1申請人須具有獨(dú)立承擔(dān)民事責(zé)任的能力，不接受自然人參與應(yīng)征。
An Applicant must have the ability to bear civil liability independently,and the participation of natural person is not accepted.
3.2申請人須具有承擔(dān)本次征集內(nèi)容相應(yīng)的資格及能力：
An Applicant must have the corresponding qualifications and abilities to undertake the content of this Project:
3.2.1申請人為境內(nèi)機(jī)構(gòu)（除港、澳、臺(tái)機(jī)構(gòu)）的，須具備中華人民共和國住房和城鄉(xiāng)建設(shè)部核準(zhǔn)的風(fēng)景園林工程設(shè)計(jì)專項(xiàng)甲級（或以上）資質(zhì)證書。境外機(jī)構(gòu)在境內(nèi)（除港、澳、臺(tái)地區(qū)）成立的子公司按照本條規(guī)定執(zhí)行。
If the Applicant is a domestic institution(except for Hong Kong,Macao or Taiwan institutions),it must have the qualification certificate of Class A in Landscape Engineering Design(or above)issued by Ministry of Housing and Urban-Rural Development,People’s Republic of China.Overseas Applicants who participate in the name of its subsidiary registered in China(except for Hong Kong,Macao or Taiwan)shall comply with this requirement.
3.2.2申請人為境外機(jī)構(gòu)的，須在其所在國家或地區(qū)合法注冊，具有相應(yīng)設(shè)計(jì)許可。港、澳、臺(tái)機(jī)構(gòu)按照本條規(guī)定執(zhí)行。
If the Applicant is an overseas institution,it must be legally registered in the country or region where it is located and be equipped with corresponding design license.Applicants from Hong Kong,Macao or Taiwan shall comply with this requirement.
3.3申請人須具有與本次征集內(nèi)容類似的項(xiàng)目業(yè)績。類似的項(xiàng)目業(yè)績系指公園綠地景觀面積在3萬平方米以上的公園景觀設(shè)計(jì)業(yè)績。
Applicants must have relevant project performances similar to this Project.Similar project refers to the design performance for parks with a green landscape area of over 30,000 square meters.
3.4本項(xiàng)目不接受聯(lián)合體。
The Consortium is NOT accepted in this Project.
4.1凡有意參加本次方案征集活動(dòng)的潛在申請人，請于2024年5月13日16:00時(shí)至2024年5月23日16:00時(shí)（北京時(shí)間，下同），在上海國際招標(biāo)有限公司網(wǎng)站（www.shabidding.com，下同）在線領(lǐng)取《資格預(yù)審文件》。
All potential Applicants who are interested in participating in this Project can download the Prequalification Document through SITC Website(www.shabidding.com)from 16:00 May 13th,2024 to 16:00 May 23rd,2024(Beijing Time,same hereinafter).
4.2申請人首次使用上海國際招標(biāo)有限公司網(wǎng)站需完成注冊程序。已注冊的申請人可使用已獲取的供應(yīng)商登錄名和密碼登錄并從網(wǎng)站采購公告欄的相應(yīng)公告中進(jìn)入，點(diǎn)擊右上角“領(lǐng)購”按鈕下載《資格預(yù)審文件》。征集代理不接受沒有在上海國際招標(biāo)有限公司網(wǎng)站上注冊和沒有《資格預(yù)審文件》下載記錄的申請人提交的《申請文件》。
Applicants who have never used SITC Website before shall finish the registration process first.Registered Applicants can download the Prequalification Document by clicking the“purchase”button in the corresponding announcement webpage on the purchase bulletin board of SITC Website after logging in.SITC will not accept the Application Documents submitted by the Applicants who have not registered on SITC Website or who have no download records of the Prequalification Document on SITC Website.
4.3申請人成功領(lǐng)取《資格預(yù)審文件》并不意味著其資格條件符合要求。申請人是否符合本公告第3條“合格申請人資格條件”由資格預(yù)審評審委員會(huì)判定。
An Applicant's successful acquisition of the Prequalification Document does not mean that it is eligible for this Project.Whether an Applicant meets the requirements of Article 3 in this Announcement is determined by the Prequalification Jury.
5.1資格預(yù)審《申請文件》應(yīng)以電子文件和紙質(zhì)文件的形式提交。提交截止時(shí)間為2024年5月24日11:00時(shí)，提交的時(shí)間以電子文件上傳成功的時(shí)間為準(zhǔn)。除了在截止時(shí)間前成功上傳的《申請文件》外，未在截止時(shí)間前上傳或以其他形式提交的《申請文件》一律不被受理。
The Application Document shall be submitted in Electronic Documents as well as Paper Documents.The submission deadline of Application Document is 11:00 May 24th,2024.The submission time of every Applicant is subject to the time when its Electronic Documents are successfully submitted.Any late submission or submission in any other form will not be accepted.
5.2電子文件包括全套正本《申請文件》的PDF掃描件和PPT文件。申請人應(yīng)在上海國際招標(biāo)有限公司網(wǎng)站本項(xiàng)目的領(lǐng)購頁面下，點(diǎn)擊“投標(biāo)文件”按鈕后上傳資格預(yù)審《申請文件》的電子文件（以rar.或zip.形式壓縮后上傳，請注意無需加密）。
The Electronic Documents shall include the scanned copy in PDF of the full set of the original Application Document and the required PPT file.Applicants shall submit Electronic Documents by clicking the“tender document”button on the this Project’s webpage and uploading via on SITC website.(Please do not encrypt the uploaded compressed file in rar.or zip.form.)
5.3申請人應(yīng)將紙質(zhì)《申請文件》2套（正本1套、副本1套），以專人送達(dá)或郵寄形式提交至征集代理。收件人信息詳見第12條“聯(lián)系方式”。
Applicants shall also submit 2 sets of Paper Documents of its Applicant Document(clearly mark one as“ORIGINAL”,and the another as“COPY”)to the Solicitation Agency in person or by delivery.See Article 12 for the recipient information.
5.4申請人應(yīng)當(dāng)確保其提交的資格預(yù)審《申請文件》的電子文件和紙質(zhì)文件內(nèi)容一致。當(dāng)資格預(yù)審《申請文件》的電子文件與紙質(zhì)文件內(nèi)容不一致時(shí)，以電子文件為準(zhǔn)。
Applicants shall ensure that the contents of their Electronic and Paper Application Document submitted are consistent.In the event of any discrepancy between the Electronic Documents and the Paper Documents,the Electronic Documents shall prevail.
申請人提交了資格預(yù)審《申請文件》后，資格預(yù)審評審委員會(huì)將對申請人進(jìn)行綜合評審和比較，選擇3名申請人作為入圍的應(yīng)征人。如申請人數(shù)量正好為3名，資格預(yù)審評審委員會(huì)將對申請人的身份和資質(zhì)、綜合實(shí)力、主創(chuàng)設(shè)計(jì)師的資歷、設(shè)計(jì)團(tuán)隊(duì)的人員配置等進(jìn)行是否符合項(xiàng)目要求的判定。如判定符合項(xiàng)目要求，3名申請人直接入圍；如判定符合要求的申請人不足3名，征集人保留重新組織資格預(yù)審的權(quán)利。如申請人少于3名，征集人同樣保留重新組織資格預(yù)審的權(quán)利。
After the submission deadline of Application Document,the Prequalification Jury will conduct a comprehensive review of all Applicants and select 3 Applicants as Shortlisted Applicants.If there are exactly 3 Applicants,the Prequalification Jury will determine whether these Applicants meet the requirements of this Project by reviewing their identity and qualification,comprehensive ability,the qualifications of the chief designers,and the staffing of the design teams,etc.If it is determined that all 3 Applicants have met the requirements,all 3 applicants will be directly shortlisted;if less than 3 Applicants are determined to have met the requirements,the Sponsor reserves the right to reorganize the Prequalification.If there are fewer than 3 Applicants,the Sponsor also reserves the right to reorganize the Prequalification.
7.1入圍應(yīng)征人在方案評審會(huì)結(jié)束，并經(jīng)方案評審委員會(huì)評定其方案符合《設(shè)計(jì)任務(wù)書》要求的，將各獲得方案征集費(fèi)人民幣70萬元（含稅）。方案被確定為優(yōu)勝方案的應(yīng)征人將對方案進(jìn)行優(yōu)化調(diào)整，并獲得獎(jiǎng)金人民幣30萬元（含稅）。
Among Shortlisted Applicants,those whose deliverables of this Project are evaluated to have met the requirements set in the Design Program by the Scheme Review Committee will receive a Scheme Solicitation Fee of RMB 700,000.00(tax included)after the Scheme Review Meeting.The Shortlisted Applicant whose scheme is determined as the winning scheme will make modification adjustments to the scheme and receive a bonus of RMB 300,000.00(tax included).
7.2如經(jīng)方案評審委員會(huì)評定，應(yīng)征人的方案沒有達(dá)到《設(shè)計(jì)任務(wù)書》要求的，應(yīng)由方案評審委員會(huì)單獨(dú)出具書面意見且有半數(shù)以上評委簽字，具體闡明不符合要求的設(shè)計(jì)內(nèi)容以及扣款標(biāo)準(zhǔn)，征集人將根據(jù)該書面意見扣減直至不支付該應(yīng)征人的方案征集費(fèi)。
If the Scheme Review Committee of the Scheme Review Meeting makes the decision that any Applicant’s deliverables of this Project failed to meet the requirements set in the Design Program,the Scheme Review Committee shall provide a written opinion with the signature of more than half of the committee to specify the unqualified contents and the deduction standard.The Sponsor is entitled to deduct a portion or all amount of the Applicant’s Scheme Solicitation Fee according to this opinion.

Once submitting the Application Document,Applicants shall be deemed to have accepted the following terms of the intellectual property rights.
10.1應(yīng)征人承諾其擁有其提供服務(wù)時(shí)編制的所有圖紙、說明、電子文檔和其它相關(guān)文件（以下總稱“成果文件”）的合法權(quán)利和知識(shí)產(chǎn)權(quán)。
The Shortlisted Applicant shall guarantee that it has the legal rights and intellectual property rights of all drawings,descriptions,electronic files and other relevant documents(hereinafter referred to as"Deliverables")prepared when it provides services.
10.2應(yīng)征人為本項(xiàng)目編制的成果文件系專用于本項(xiàng)目，各方均不得超過此范圍使用。
The Deliverables prepared by the Shortlisted Applicant are exclusively for this Project and shall not be used by any party beyond this scope.
10.3所有由應(yīng)征人編制的成果文件，其著作權(quán)歸應(yīng)征人所有。在征集人向應(yīng)征人付清本公告第7條定義的方案征集費(fèi)之后，除署名權(quán)等人身權(quán)利以外，該部分成果文件的所有權(quán)和著作權(quán)歸征集人所有，征集人有權(quán)使用、復(fù)制、修改及宣傳成果文件，應(yīng)征人僅享有將成果文件用于自身宣傳、評獎(jiǎng)、論文撰寫、員工職稱評定等的權(quán)利。
The Shortlisted Applicant has the copyright of all its Deliverables.Except for the moral rights such as right of paternity,the ownership and copyright of the Deliverables belongs to the Sponsor upon full payment for the Scheme Solicitation Fee defined in Article 7 of the Prequalification Announcement.The Sponsor has the right to use,copy,revise and publicize the Deliverables.The Shortlisted Applicant only has the right to use the Deliverables for self-promotion,award evaluation,paper writing and employee title evaluation.
10.4應(yīng)征人應(yīng)保證提交的成果文件在中國境內(nèi)或境外沒有且不會(huì)侵犯任何其他人的知識(shí)產(chǎn)權(quán)（包括但不限于著作權(quán)、專利權(quán)）或?qū)Ｓ屑夹g(shù)或商業(yè)秘密。應(yīng)征人應(yīng)保證，如其成果文件使用或包含任何其他人的知識(shí)產(chǎn)權(quán)或?qū)Ｓ屑夹g(shù)或商業(yè)秘密，應(yīng)征人已經(jīng)獲得權(quán)利人的合法、有效、充分的授權(quán)。應(yīng)征人因侵犯他人知識(shí)產(chǎn)權(quán)或?qū)Ｓ屑夹g(shù)或商業(yè)秘密所引起的全部法律責(zé)任應(yīng)由應(yīng)征人承擔(dān)。
The Shortlisted Applicant shall ensure that its Deliverables does not and will not infringe the intellectual property rights(including but not limited to copyright and patent right)or proprietary technology or trade secrets of any other person within or outside China.The Shortlisted Applicant shall guarantee that if its Deliverables uses or contains the intellectual property rights,proprietary technology or trade secrets of any other person,the Shortlisted Applicant has obtained the legal,effective and sufficient authorization of the owner.The Shortlisted Applicant shall be liable for all legal responsibilities arising from its infringement of others'intellectual property rights,proprietary technology or trade secrets.
11.1資格預(yù)審公告使用中文和英文書寫。當(dāng)中、英文兩種語言的意思表達(dá)不一致時(shí)，以中文為準(zhǔn)。
The Prequalification Announcement is written both in Chinese and English.In case of inconsistency between Chinese and English,Chinese shall prevail.
11.2凡參加本次資格預(yù)審的申請人均被視為同意并接受《資格預(yù)審文件》的全部內(nèi)容及條款。
All Applicants participating in this prequalification are deemed to agree and accept all the contents and terms of the Prequalification Document.
11.3申請人在資格預(yù)審《申請文件》中所列出的主創(chuàng)設(shè)計(jì)師須親自開展本項(xiàng)目的設(shè)計(jì)工作，須參加項(xiàng)目啟動(dòng)會(huì)與現(xiàn)場踏勘，須進(jìn)行成果方案匯報(bào)。因此，請所列出的主創(chuàng)設(shè)計(jì)師根據(jù)征集活動(dòng)時(shí)間安排提前預(yù)留時(shí)間、做好準(zhǔn)備。如因旅行限制原因，例如全球或區(qū)域流行病疫情等，主創(chuàng)設(shè)計(jì)師確實(shí)無法赴現(xiàn)場參會(huì)的，須在資格預(yù)審《申請文件》中進(jìn)行說明，并承諾將通過視頻或電話會(huì)議的方式參會(huì)。所述情況將在資格預(yù)審評審時(shí)予以綜合考慮。
The chief designer listed in the Application Document must carry out the design work,attend the Kick-off Meeting,participate in Site Visit and present the Deliverables IN PERSON.Therefore,please make well preparation in advance according to the Schedule of Solicitation.If the chief designer is indeed unable to attend the meetings on site in the event of travel restrictions such as global or regional epidemics,he or she should make an explanation in the Application Document and promise to attend meetings by video or telephone.It will be taken into consideration by the Prequalification Jury.
11.4本次征集活動(dòng)及相關(guān)文件的最終解釋權(quán)歸征集人。
The Sponsor reserves the right of final interpretation of this Project and related documents.
